I want to take a few minutes to answer the number one question &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; most people have when first hearing about tax delinquent real estate investing and &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; is "What are the risks involved?" This is a valid question and is something that I thought long and &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; about before I began building my wealth through tax delinquent real estate.&lt;/p&gt;&lt;p&gt;One of the major potential risks that I hear about frequently from real estate investor "newbie's" is "What do I do if I get myself locked into a bad deal?" Well for sure there are times when &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; may realize that after being half-way into a deal, it turns out to be not as good as you expected, &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; you come across some unforeseen circumstance that has swayed the deal &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; the wrong direction and you have to back out to avoid loss of profit. &lt;br&gt;Certainly in my years of experience I have come across my fair share.&lt;/p&gt;&lt;p&gt;What I do to protect myself from these unknown or hidden "landmines"? Well there are couple things that do. 1.) I always structure my purchase contract in a way that it allows &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; to have no money into the deal until the time of closing. This allows me to make all my final checks on the property within the escrow period without any obligation to pay to any money to back out of the deal. 2.) Make sure you have escape clauses that state that you have the right to back out if it does not pass your inspection.&lt;/p&gt;&lt;p&gt;With no money down and the option to back out, I feel that there is almost zero risk involved in any kind of real estate transaction that is structured &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; way. This empowers me with the ability to shore up a deal very quickly while still allowing me to sleep easy at night. Whenever I feel that there is something wrong with a deal, I can simply back out. The UN-controlled Green Line &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; the two.&lt;/p&gt;&lt;p&gt;If you are considering buying property on the island, it is probably best to stick to the south. There are risks in the north, but these are most concerned with the issue of title. Prices in the north, however, are much cheaper.&lt;/p&gt;&lt;p&gt;On the south coast are resorts such as Paphos, Limassol, Larnaca and Famagusta. Paphos on the south western corner is famous for its ancient ruins, and has a number of excellent resorts close by. When you sign the contract around 20-30% of the purchase price will be due, and the balance must be paid on completion. Yes and no.&lt;/p&gt;&lt;p&gt;While you can start investing in real estate with absolutely &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; cash, you will &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; it very challenging.&lt;/p&gt;&lt;p&gt;With a &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; cash, a &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; hundred dollars, you will find it much easier to start your real estate investing business.&lt;/p&gt;&lt;p&gt;What types of investing can you do with little or no cash?&lt;/p&gt;&lt;p&gt;Bird Dogging&lt;/p&gt;&lt;p&gt;You can be a bird dog and find potentially motivated sellers to turn over to &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; real estate &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; who is willing to take the next step and negotiate with the seller to purchase the house.&lt;/p&gt;&lt;p&gt;Your expenses as a bird dog are in finding potentially motivated sellers.&lt;/p&gt;&lt;p&gt;Wholesaler&lt;/p&gt;&lt;p&gt;You can be a wholesaler and find deals and put them under contract then find another investor or retail buyer to buy the houses from you for more &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; you have it under contract for.&lt;/p&gt;&lt;p&gt;Your expenses as a wholesaler are finding motivated sellers, putting up money to control the property (binder deposit or option consideration) and finding your investor or retail buyer.&lt;/p&gt;&lt;p&gt;What if I have some money (a few thousand dollars or more)?&lt;/p&gt;&lt;p&gt;With a few thousand dollars, you might consider some no money down deals being especially careful not to commit to making payments on the house until you have lined up your tenant, buyer or tenant-buyer.&lt;/p&gt;&lt;p&gt;Your cash need in buying and selling houses with no money down is the holding costs and marketing and not necessarily the down payment.&lt;/p&gt;&lt;p&gt;For example, often times when we buy a house "subject to" the existing financing, where we agree to make payments on the seller's existing mortgage, we are not putting any money down. We are merely agreeing to make payments on their existing mortgage.&lt;/p&gt;&lt;p&gt;Even if the seller agrees that you will start making payments only when you find a tenant or tenant-buyer, you might still have marketing costs and in the event the property goes vacant you should be able to make the mortgage payments while you find another tenant or tenant-buyer.&lt;/p&gt;&lt;p&gt;You will notice that I did not include buying houses "subject to" the existing financing in the category of little or no money. We are going to focus on income-producing investment properties, like retail strips, office buildings, warehouses, &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; apartment complexes. The principles discussed below &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; apply to single tenant net lease investments, like drug stores or fast-food outlets and virtually any other type of investment real estate including the newest structure, a Tenant in Common or TIC.&lt;/p&gt;&lt;p&gt;Three Keys&lt;/p&gt;&lt;p&gt;There are &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; key reasons for buying income-producing investment real estate; cash flow, appreciation, and the tax benefits.&lt;/p&gt;&lt;p&gt;A word of caution here, if the deal does not work without the tax benefits, do not let them be the deciding factor. Tax benefits are purely a deal sweetener and should never be relied upon to make the difference.&lt;/p&gt;&lt;p&gt;Cash Flow &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; defined as the positive income stream generated from rentals paid by the tenants, less any operating expenses incurred in the operation and ownership of the &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; including debt service. In general, investors look for a positive cash flow, where the income exceeds the expenses at an annual rate of return commensurate with the risk. The &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; the risk, the higher the expected return to the investor. In some cases, investors see opportunities even if there is negative and/or little cash flow. In this case the investor sees a clear trend that will create a "value added" opportunity.&lt;/p&gt;&lt;p&gt;Appreciation - defined as the increase in value of the property during the period of ownership. Typically, the investor anticipates that the property will increase in value, and the debt owed on the property will decrease, thus the investor's equity in the property, as well as their net worth, also increases. The beauty of investment property is that the tenant is doing all of the work and is paying down the debt. I like to think about that on days when I am on the beach and my property is working for me.&lt;/p&gt;&lt;p&gt;Tax Benefits can be defined in several ways but the two most often cited are mortgage interest deduction and property depreciation. A second word of caution is that this is a very technical area, and a qualified tax professional should always be consulted prior to making any decisions. You are allowed to deduct any interest paid on the debt used to acquire the property. In the early years, this can be a significant amount. Later on, as the interest on the loan is reduced and you are paying down more on the principle, you may wish to look at selling and trading into another property. The other benefit typically taken is depreciation or cost recovery. The IRS provides for several different means of determining the amount of depreciation an investor can take on a property. Some of the keys to how &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; your write off is to determine the investor "basis" in the property, whether they are engaged in the business of real estate, and the adjusted gross income of the investor. A second consideration is whether or not the property is acquired through a 1031 exchange. While cost recovery deductions increase an investor's after-tax cash flow, a Section 1031 Exchange allows for an investor to continually "trade up" to higher value properties while deferring the capital gains taxes due on the appreciation.&lt;/p&gt;&lt;p&gt;Who invests in real estate?&lt;/p&gt;&lt;p&gt;Private real estate investors are a wide cross-section of people: a fireman, a lawyer, a retired businessman, a regional manager for a Fortune 200 company. I've worked with all ages, creeds and points of view and they all have a couple of common interests. They enjoy making money, they feel good about investing for their retirement and they love the tax benefits. Most use the tax-deferred exchange method on a regular basis to upgrade their portfolio and defer the tax until later. Some investors start young while others wait until their kids have completed school and they have some extra money each month. All of the investors I have worked with believe strongly in the wisdom of real estate investing, have a good sense of value, and are great with "the numbers."&lt;/p&gt;&lt;p&gt;How do I get started?&lt;/p&gt;&lt;p&gt;You can do it the old fashioned way and drive around taking note of the income-producing properties you see. They're everywhere. You probably won't see "for sale" signs on many of these properties, but that doesn't mean that they can't be bought. You will have to visit the Courthouse and check the ownership records. In some counties, you will be able to access the property ownership on-line through the assessor's office.&lt;/p&gt;&lt;p&gt;As the saying goes, "everything is for sale, at the right price."&lt;/p&gt;&lt;p&gt;Poking around and doing it yourself is time consuming and unless you have the right skill set, it will be frustrating and not very fruitful. I would recommend you retain the services of an experienced investment property broker, to help you investigate, analyze, and acquire property.&lt;/p&gt;&lt;p&gt;The final means of acquiring investment property is to investigate acquiring a Tenant In Common interest in a stabilized property. The advantages of a &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; investment are: they are tailor made to the exact amount you are investing (because it is a fractional interest);higher leverage (pre-arranged by the sponsor); institutional properties with credit-worthy tenants; predictable cash-flow;easy tax reporting; no management obligations; and all of the due diligence has been completed and ready for your review. The primary disadvantages include high loads; the potential lack of liquidity; some unscrupulous sponsors, primarily lacking in experience; risk of partnership treatment; and the nature of the TIC itself (it can be burdensome). Further, TIC investors generally must be accredited investors, meaning they must meet certain income or net worth thresholds. Nevertheless, for passive investors, the advantages of TIC's clearly outweigh the burdens.&lt;/p&gt;&lt;p&gt;I always recommend that you work with a professional adviser, be it a CPA, a lawyer or a real estate broker to determine a target price for an acquisition. Other professionals can include a property manager, a commercial insurance broker, a commercial appraiser, and a commercial lender. The lender can play an important role in qualifying the buyer prior to an acquisition, or in pre-qualifying a property for financing before acquisition.&lt;/p&gt;&lt;p&gt;Overall, an investment in income-producing real estate is a great long term investment, realizing that it is not as liquid as stocks and bonds; it should be approached with a healthy dose of estate planning first. They become aware of the disastrous consequences that can befall property owners who own property in their personal names.&lt;/p&gt;&lt;p&gt;All it takes &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; a couple of mouse clicks in the age of the Internet to get a complete listing of every property owned &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; you in the &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; county! You can &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; everything you own, not just the real estate, to judgment creditors, lawsuits, liens, the IRS, etc.&lt;/p&gt;&lt;p&gt;It is a proven fact, that those who can be shown to own property are at a far higher risk of being sued than those who do not own property.&lt;/p&gt;&lt;p&gt;Then they have to decide. Should they use a corporation to hold their property, a C corp. or an S corp? How about an LLC or a partnership?&lt;/p&gt;&lt;p&gt;There are serious downsides to using the wrong or inappropriate entity.&lt;/p&gt;&lt;p&gt; Double &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; on income and gains with a C corp.&lt;/p&gt;&lt;p&gt; Corporate taxes are levied on property sold by an S corp.&lt;/p&gt;&lt;p&gt; Ownership and allocation of profits is sharply restricted in an S corp&lt;/p&gt;&lt;p&gt; The corporation itself (shares) can be seized by creditors along with any real estate it owns&lt;/p&gt;&lt;p&gt; LLC's can provide liability protection, but only to business, not personal property&lt;/p&gt;&lt;p&gt; Neither corporations nor LLC's provide secrecy of ownership&lt;/p&gt;&lt;p&gt; The extra cost and complexity of setting up, reporting taxes and maintaining the entity&lt;/p&gt;&lt;p&gt; Partnerships can expose partner's assets to unlimited liability&lt;/p&gt;&lt;p&gt;Compounding the problem is the fact that banks will generally not OK the purchase of a 1-4 family property by any entity, even a limited partnership.&lt;/p&gt;&lt;p&gt;There is also a prohibition, the due on sale clause; that allows the bank to foreclose on the mortgage on a property that is transferred from the personal name of the borrower to an entity.&lt;/p&gt;&lt;p&gt;There could also be a problem if the owner wanted to do a 1031, tax-free exchange, if the title was transferred from the original owner.&lt;/p&gt;&lt;p&gt;The solution is for the real estate investor to set up a land trust.&lt;/p&gt;&lt;p&gt; A land trust provides total secrecy of ownership.&lt;/p&gt;&lt;p&gt; It provides asset protection.&lt;/p&gt;&lt;p&gt; It carries no tax implications, it is a pass through entity, meaning that any gains or losses pass through to the owner's personal tax return.&lt;/p&gt;&lt;p&gt; Although most banks will not grant a mortgage to a property in a land trust, the due on sale clause cannot be invoked against the transfer of title to a properly constructed land trust.&lt;/p&gt;&lt;p&gt; It does not impair the ability to do a 1031 tax free exchange&lt;/p&gt;&lt;p&gt; It eliminates the need for probate upon the owner's death&lt;/p&gt;&lt;p&gt;What is a land trust? It is simply a revocable contract between two or more parties. It has been in use for centuries.&lt;/p&gt;&lt;p&gt;The first party is the owner of the property; the grantor, in trust speak. He grants, or transfers title to the property to the trustee. He then becomes the beneficiary, along with any co-owners. Beneficiaries of the trust retain management, control and the right to receive profits from the property&lt;/p&gt;&lt;p&gt;The trustee is often a non-profit corporation. The trustee's only job is to hold title to property for owners. He is prevented by law from divulging the identity of the beneficiaries (the true owners).&lt;/p&gt;&lt;p&gt;He is also prevented by law from doing anything with the property that is not &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; in writing by the beneficiaries.&lt;/p&gt;&lt;p&gt;The beneficiaries can revoke or cancel the trust agreement whenever they want, which is not a taxable event.&lt;/p&gt;&lt;p&gt;Although the land trust is revocable, in other words a living trust, it should not be confused with a simple living trust, set up for probate avoiding purposes, as it often is, even by attorneys.&lt;/p&gt;&lt;p&gt;The land trust can provide asset protection in two ways. Number one, it provides secrecy of ownership, which may be all that is required to dissuade potential litigants, as it makes their ownership invisible.&lt;/p&gt;&lt;p&gt;Secondly, if the trustee is a corporation in another state, a sophisticated move; any potential litigant is faced with the prospect of suing an out of state, professional corporation. They must win their case if they are to legally force the trustee to reveal the identity of the beneficiaries. This prospect will discourage all but the most aggressive plaintiffs.&lt;/p&gt;&lt;p&gt;For maximum asset protection, the beneficiaries should set up an LLC to hold the beneficiary interests. Sort of like wearing suspenders with a belt.&lt;/p&gt;&lt;p&gt;No attorney is not needed to set up a land trust, but you have to make sure you are using a person or company with experience in setting them up, or you may not get what you pay for!&lt;/p&gt;&lt;p&gt;Copyright 2006 Bill Young. In order to do that I left nothing to chance. I did an incredible amount of research and learning about how properties are rehabilitated, how repairs are cost, how property financing works and how deals are closed. Anything and everything that had to do with buying houses, selling houses, buying and renting apartments and developing an apartment portfolio.&lt;/p&gt;&lt;p&gt;The reason I put in so much hard work is because, all the while, I knew I was working towards very specific targets and very specific ideas and I was learning where the shortcuts were and what I should be looking out for each time I closed a deal.&lt;/p&gt;&lt;p&gt;What I &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; quite early on, is that if you handle them properly, are careful in what you invest in and know how to set up a remote management network so that you do not have to deal with a single tenant, ever, multi-family properties can &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; you on your road to financial success.&lt;/p&gt;&lt;p&gt;The reason for this lies in what I like to call the income development curve. With any single-family dwelling that curve depends upon a number of variables that rely on the single &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; living there. The moment you consider multiple-family dwellings you begin to spread the risk of stagnating. I will give you an example: suppose you are letting out a single-family dwelling and the family moves or are &lt;a href=http://txprivatenotes.com/noble1.html&gt;Noble1&lt;/a&gt; unable to pay the rent? A couple of months' inaction plus the cost of finding a new tenant are enough to wipe out your profit margin. Suppose, in a slightly different scenario, that you need to carry out repairs to the property and the tenant cannot afford to contribute their maintenance fee for that property? You are forced to either evict the tenant and risk losing more money or pay for the repairs yourself and try to work out an agreement to get your money back. All of this is a nightmare initiated by what I call a linear chain of action where you and the tenant are engaged in what might at times look like a tag of war between you and the tenant.&lt;/p&gt;&lt;p&gt;What experience has taught me is that when you are dealing with multi-family dwellings you no longer have to engage in this linear action. You have multiple interests, which represent the group of tenants, pooling their resources together to meet repairs, and maintenance. Add to this fact that when a tenant leaves the others are still paying their rent while you find a new one and you realise that in terms of making money multi-family dwellings maximise the opportunities and minimise the risks.&lt;/p&gt;&lt;p&gt;Of course the 'formula' as such is more complicated than that and I cover a lot of this in the real estate success workshops I offer.
